Back to Basics Program Terms and Conditions
This Agreement effective as of the date set forth below, governs the terms and conditions for participation by the Participant identified below (“Client”) in the Back to Basics Program (“Program”) created by Mind Body Rehab (“Company”).
The Program
The Program is a minimum four (4) week program organised to guide and educate the Client on knowledge and skills to truly master the mind body connection to better manage their health issues and pain. The Client has access to the program as soon as they enrol (“Program Start Date”). Program End Date will be 4 calendar weeks from Program Start Date (“Program End Date”). The content of this Program will be provided to Participant upon the Program Start Date but is subject to modification at any time per the discretion of the Company. The Client has access to the content for lifetime. If the Client wishes to have continued access to Danielle or ongoing coaching after this 4 week period, a month-month agreement or enrolment into Unshakeable Program will be made. The Program access will be available to Participant between the Program Start Date and Program End Date ("Enrolment Period") subject to Participant following the terms of this Agreement.
Program Payments Terms
Mind Body Rehab has different payment plans to suit different needs of the Client. The Program has the following payment plans:
• Upfront payment with a one time payment of $100
The Program includes:
• Access to the student portal with all included content and program material indefinitely;
• Access to weekly group coaching calls for the duration of the Enrolment Period plus access to weekly check in/office hours via Whatsapp for the duration of the Enrolment Period.
When the Client selects the Full Payment option your provided payment method will be debited immediately. The Client can update their payment details via emailing [email protected]
Failed Payments
It is up to The Client to keep their payment details current. The Client will be notified via email if a payment has failed. A re-attempt will be tried by our payment gateway three (3) days after the first failed attempt. After two (2) failed payments the Client will be removed from the online student portal and no longer have access to the program. Should the Client wish to rectify the payments with a payment that is confirmed, the Client will then be admitted back into the program.
Love It Or Leave It Guarantee
If The Client does not love the program at the 4 week mark, The Client can let Mind Body Rehab know via email and a full refund will be made. If this is the case, they will have their student portal access revoked immediately.
Clients Conduct and Responsibilities
The Client agrees to conduct him/herself within the Program in a considerate and professional manner and shall not engage in any activity that is detrimental to the health, safety, and welfare of Danielle Dieben. The Client acknowledges and agrees that the Company reserves the right to remove Clients from the Program, without reimbursement, if the Company, in its sole discretion, determines that Client's behaviour creates a disruption or hinders the Program or the enjoyment of the Program by others. It is the responsibility of the Client to implement the process inside the Program. The Clients results are contingent on a variety of factors, including but not limited to the Clients current health conditions, work ethic, and desire to achieve results. The Client agrees that deciding how to incorporate the Program methods into the Clients life, implementing such choices, and staying consistent is exclusively the Participant’s responsibility. The Client acknowledges that any Program content, materials, coaching, or guidance the Client receives during the course of the Program is to be used as guidance and is not a substitute for Purchasers’s responsibility of applying the Program methods to Client’s life.
Privacy The information shared by the Clients to the Company or other participants will be kept confidential. The Client also acknowledges that any material inside the Program is confidential and shall not be shared with third parties.
Information and personal data
Your personal information and data including full name and email address will be used to communicate to you throughout the course and beyond. Should you wish to no longer receive Mind Body Rehab emails you can unsubscribe at any time using the unsubscribe button on the bottom of emails or by emailing [email protected] . Release The Client agrees that the Company may use any written text, or video recordings of Client obtained while enrolled in the Program in connection with the Program, including but not limited to testimonials. The Client waives any right to payment, royalties or any other consideration for the use of such text, audio recordings, or video recordings. The Client waives the right to inspect or approve the finished product, including written or electronic copy, wherein Clients likeness appears. The Company is held harmless, released, and forever discharged from all claims, demands, and causes of action which Client, their heirs, representatives, executors, administrators, or any other persons acting on Clients behalf of the Clients estates have or may have by reason of this authorisation.
Intellectual Property
All intellectual property rights in and to the Program, the Program content, and all materials distributed at or in connection with the Program are owned by the Company or the Program partners presenting during the course of the Program. The Client will not use or reproduce or allow anyone to use or reproduce such content or materials displayed at, distributed at, for any reason without the prior written permission of the Company.
Access to the Course Content
The course content will be available to the Client for the duration of the Enrolment Period. Should Mind Body Rehab discontinue, you will be notified via email. We will do everything we can to provide you with the course material even after it is no longer accessible via Mind Body Rehab.
Medical Disclaimer
The Mind Body Rehab Website, Back to Basics Program and consultations with Danielle Dieben have all been created for the purpose of education only. Nothing shown here by its author(s) should be construed as being in the nature of a diagnosis, treatment, prescription, or a cure for disease. All information, consultations, or programs should not replace medical advice or treatment. Results, case studies, and testimonials are all true however results may vary and are not guaranteed. If you have been diagnosed with a disease, condition, or medical problem, please consult your medical doctor or qualified health care professional prior to starting a consultation or program with Danielle Dieben or Mind Body Rehab. It is up to The Client to inform Mind Body Rehab of any health conditions, medical problems or diseases that have been diagnosed by a health care professional before starting a consultation or program. Revoking program from The Client Mind Body Rehab has the right to terminate the Clients access to the program without explanation. Termination will be provided in writing via email. Access from course material/ portal and Voxer will be revoked at this time indefinitely.
Disclaimer of Warranties
The Company gives no warranties with respect to any aspect of the Program or any materials related thereto or offered in connection with the Program and, to the fullest extent possible under the laws governing this Agreement, disclaims all implied warranties, including but not limited to warranties of fitness for a particular purpose, accuracy, timeliness, and merchantability. The Client accepts and agrees that they are fully responsible for their progress and results and that the Company offers no representations, warranties or guarantees verbally or in writing regarding Clients present and future health and pain or result of any kind. The Company does not guarantee that the Client will achieve any results using the ideas, tools, strategies or recommendations presented at the Program, and nothing in the Program is a promise or guarantee to the Client of such results.
Entire Agreement Waiver
This Agreement constitutes the entire agreement between the Client and the Company and supersedes all prior and contemporaneous agreements, representations, and understandings between the Parties. No waiver of any of the provisions of the Agreement by Company shall be deemed, or shall constitute a waiver of any other provision, whether or not similar, nor shall any waiver constitute a continuing waiver. No waiver shall be binding unless executed in writing by Company.
